This Privacy Policy outlines the practices of SwapMarket LLC regarding the collection, use, and disclosure of your information. It applies to all users of the SwapMarket application and its associated services. By accessing or using SwapMarket, you signify your agreement to the terms of this Privacy Policy.

1. Entity & Jurisdiction

This Privacy Policy governs the data practices of SwapMarket LLC, a company incorporated in Virginia. The laws of the Commonwealth of Virginia shall govern this policy. Furthermore, SwapMarket LLC is committed to complying with applicable data protection laws, including the California Consumer Privacy Act (CCPA) and the Virginia Consumer Data Protection Act (VCDPA).

2. Data Collected Directly From Users

SwapMarket LLC collects various types of information directly from its users to provide and improve its services. This includes, but is not limited to:

  • Account Information: When you create an account, we collect your username, email address, and optionally, your phone number and profile photo.
  • Coarse Location Data: We collect approximate location data, specifically your city or general area, to facilitate local trading. We explicitly state that precise GPS location data is never collected.
  • Item Listing Information: When you list items for trade, we collect details such as photos of the items, descriptions, categories, condition ratings, relevant tags, and your trade preferences.
  • Communication Data: We collect messages and images exchanged through our in-app chat feature.
  • Trade Activity and History: Information related to your trading activities and historical transactions on the platform is collected.
  • Reviews and Trustworthiness Ratings: We collect data pertaining to reviews you provide or receive, as well as trustworthiness ratings associated with your account.
  • Support and Reporting Data: Any support requests or reports of issues submitted by you are collected to assist in resolving problems and improving user experience.
  • Onboarding Interest Tags: During the onboarding process, we may collect interest tags to personalize your experience and connect you with relevant content and users.

3. Data Collected Automatically

In addition to information provided directly by users, SwapMarket LLC automatically collects certain data to ensure the functionality, security, and performance of its platform. This automatically collected data includes:

  • Authentication and Session Tokens: These are collected to manage user sessions and maintain authentication within the application.
  • Account Creation Timestamps: We record the date and time when user accounts are created.
  • Push Notification Tokens: These tokens are collected to enable the delivery of push notifications to your device.
  • Device Platform Type: We collect information about the type of device platform you are using (e.g., iOS or Android).
  • Usage Data: This includes data on item views, saves, and trade activity within the application.
  • Message Read Receipts: We collect information indicating when messages have been read in the in-app chat.
  • In-App Behavioral Signals: These signals are used for purposes such as feed ranking, enhancing security measures, and ensuring the overall reliability of the platform.

4. Data Received From Third Parties

SwapMarket LLC may receive certain data from third-party services to enhance user experience and provide essential functionalities. The types of data received and the third parties involved are as follows:

  • Google Sign-In / Apple Sign-In: If you choose to use Google Sign-In or Apple Sign-In for authentication, these services may provide us with your email address and basic profile information, such as your name.
  • Supabase: Supabase handles user authentication for SwapMarket LLC. This service processes user IDs, email verification statuses, authentication events, and IP logs to ensure secure access to the platform.
  • RevenueCat: RevenueCat manages subscription status events, including purchases, renewals, and cancellations. It is important to note that no payment card data ever touches SwapMarket LLC's servers; all payment processing is handled securely by RevenueCat.
  • Expo: Expo processes push notification tokens to facilitate the delivery of notifications to your device.
  • Sentry: SwapMarket LLC utilizes Sentry for comprehensive crash reporting, error monitoring, and session replay functionalities. Sentry may collect crash reports, error events, stack traces, device type, operating system version, and application version. Session replays are recorded for approximately 10% of standard user sessions and 100% of sessions where an error occurs. All textual and image content within session replays is masked, meaning Sentry receives only a visual skeleton of the screen layout, not readable content. An anonymous internal user ID is attached to error events solely for the purpose of counting affected users per crash. No email addresses, usernames, precise location data, payment information, or message content is transmitted to Sentry. Session replay data is used exclusively for diagnosing crashes and user interface errors. For detailed information on Sentry's data practices, please refer to sentry.io/privacy.

5. What SwapMarket LLC Does NOT Collect

SwapMarket LLC is committed to user privacy and explicitly states that it does not collect the following types of data:

  • Precise GPS Location: We do not collect exact geographical coordinates.
  • Payment Card Information: All payment processing is handled by third-party services, and we do not store or process your payment card details.
  • Device Contacts: We do not access or collect information from your device's contact list.
  • Microphone or Audio Data: We do not record or collect any audio data from your device's microphone.
  • Photos or Files Outside Intentional Uploads: We only collect photos or files that users intentionally upload to the platform for listing items or in chat communications.

6. How Data Is Used

The data collected by SwapMarket LLC is utilized for various purposes essential to operating and improving the platform, including:

  • Platform Operation: To operate the application and facilitate connections between local traders.
  • Personalization: To rank and personalize the content feed to enhance user experience.
  • Communication: To send push notifications and marketing emails, where users have opted in.
  • Performance and Reliability: To continuously improve the performance, stability, and reliability of the platform.
  • Safety and Security: For safety, security, and fraud prevention measures to protect our users and the integrity of the platform.
  • Subscription Processing: To process premium subscriptions through our partnership with RevenueCat.

7. Data Sharing

SwapMarket LLC maintains a strict policy of never selling user data to any third party. Any sharing of data with the third parties listed in Section 4 is strictly limited to the information necessary for them to perform their specific functions on our behalf. Analytics partners receive only anonymized and/or aggregated data, ensuring individual user identification is not possible. We do not engage in any ad platform data sharing.

8. Law Enforcement Disclosure

SwapMarket LLC may be required to disclose user data in response to a legal obligation. Such disclosures will only occur if mandated by law, a valid court order, a subpoena, or other legitimate legal processes. In such instances, SwapMarket LLC will endeavor to notify affected users of such requests, provided it is legally permissible to do so.

9. Data Retention After Account Deletion

Upon account deletion, SwapMarket LLC adheres to the following data retention policies:

  • Profile Data: Information such as your name, profile photo, email address, and username is deleted immediately upon account deletion.
  • Listings and Messages: While your listings and messages are anonymized, they are retained with token references for a specified period.
  • Standard Users: For standard users, anonymized data is retained for a period of one (1) year following account deletion.
  • Flagged Users: For users whose accounts have been flagged for policy violations or other issues, anonymized data is retained for a period of two (2) years following account deletion.

10. Security

SwapMarket LLC implements industry-standard security practices, including encryption and the use of secure servers, to protect user data. While we strive to protect your personal information, it is important to understand that no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee absolute security of your data.

11. Data Breach Notification

In the unfortunate event of a data breach affecting your personal data, SwapMarket LLC will notify affected users via email, in accordance with applicable legal requirements.

12. User Rights — All Users

All users of SwapMarket LLC have certain rights regarding their personal data:

  • Right to Access: You have the right to request a copy of all personal data that SwapMarket LLC holds about you.
  • Right to Deletion: You have the right to delete your account and associated personal data, subject to the anonymized retention policy outlined in Section 9.
  • Right to Opt-Out of Marketing: You can opt out of receiving marketing emails by utilizing the unsubscribe feature in the "Notifications" section on the app.
  • Right to Manage Push Notifications: You can manage your push notification preferences directly through your device settings.
  • Submission of Requests: To exercise these rights, please submit your requests to privacy@swapmarket.app.

12.1. CCPA — California Residents

California residents are afforded specific rights under the California Consumer Privacy Act (CCPA):

  • Right to Know: You have the right to know what personal data is collected about you and how it is used.
  • Right to Delete: You have the right to request the deletion of your personal data.
  • Right to Opt-Out of Sale: You have the right to opt out of the sale of your personal data. Please note that SwapMarket LLC does not sell user data.
  • Right to Non-Discrimination: You have the right not to be discriminated against for exercising your privacy rights.
  • Submission of California-Specific Requests: California-specific requests can be submitted to privacy@swapmarket.app.

12.2 VCDPA — Virginia Residents

Virginia residents are afforded specific rights under the Virginia Consumer Data Protection Act (VCDPA):

  • Right to Access, Correct, Delete, and Port: You have the right to access, correct inaccuracies in, delete, and obtain a portable copy of your personal data.
  • Right to Opt-Out of Targeted Advertising and Data Sales: You have the right to opt out of targeted advertising and the sale of personal data. Please note that neither of these activities applies to SwapMarket LLC.
  • Right to Appeal: You have the right to appeal a denied privacy request.
  • Submission of Virginia-Specific Requests: Virginia-specific requests can be submitted to privacy@swapmarket.app.

13. Minors

The SwapMarket LLC platform is intended for use by individuals who are 16 years of age or older. SwapMarket LLC does not knowingly collect personal data from children under the age of 13. If we become aware that we have inadvertently collected data from a child under 13, such data will be promptly deleted from our systems.

14. Acquisition

In the event that SwapMarket LLC is acquired by another entity, users will be notified of such acquisition. Users will be required to re-consent to the terms of the privacy policy before any data is transferred to the new entity.

15. Privacy Policy Updates

SwapMarket LLC reserves the right to update this Privacy Policy at any time. Users will be notified of any material changes to this policy via email or through an in-app notice. Your continued use of the platform after such notifications constitutes your acceptance of the updated Privacy Policy.

16. Cookies and Tracking Technologies

SwapMarket LLC operates as a native mobile application and, as such, does not utilize browser cookies, web pixels, ad tracking SDKs, retargeting pixels, or behavioral tracking tools commonly associated with web-based platforms. This means there is no integration of technologies such as Facebook Pixel, Google Tag Manager, TikTok Pixel, or similar equivalents within the application. The only external network data collection occurs through Sentry, as detailed in Section 4, and through SwapMarket LLC's own backend API, which processes requests essential for the operation of the service.
